These terms cover your use of FIELDCAST. Plain language, because you should be able to read them without a lawyer.
The short version. Pay your subscription, use the service lawfully, and your data stays yours. We keep the software running and will tell you before anything material changes. Either of us can end the arrangement.
Software for trade contractors: a website, estimates, invoices, payment collection, scheduling and marketing tools. We provide the software. We do not perform any trade work, and we are not a party to the agreement between you and your customers.
Money from your customers flows through Stripe, directly into your own connected Stripe account. We never hold your funds. Your relationship with Stripe is governed by Stripe's own agreement, which you accept during onboarding.
Refunds and disputes with your customers are between you, your customer, and Stripe. We can help you find the records; we cannot reverse a payment on your behalf.
Your business information, photos, customer records and invoices remain yours. You grant us only the permission needed to operate the service — storing it, displaying it on your website, and sending it where you direct.
You are responsible for having the right to whatever you upload. Do not upload photos of a customer's property without their permission, which is what the consent flow in the app is for.
Do not use FIELDCAST to send unsolicited bulk email, misrepresent your business or credentials, publish false claims about licensing or insurance, break the law, or interfere with the service. We may suspend an account that does.
We work to keep FIELDCAST running but do not promise uninterrupted service. Maintenance, third-party outages and faults happen. We will restore service as quickly as we can, and we take backups — though you should keep your own copies of anything critical.
FIELDCAST connects to Stripe, Google, domain registrars, hosting and email providers. Each has its own terms. We are not responsible for their outages, policy changes, or decisions about your account with them — including whether Google approves a Business Profile API request.
We provide the software as it is. To the extent the law allows, our total liability for any claim is limited to what you paid us in the 12 months before it arose. We are not liable for lost profits or lost business.
Nothing here limits liability that cannot legally be limited.
We may update these terms. For material changes we will email account holders at least 14 days before they take effect. Continuing to use FIELDCAST after that means you accept them.
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules.
